Since 1985, this division of Edward R. Kirby & Associates has shown a
tremendous growth, and the firm now represents some of the most famous
trademark holders in the world. The company has been involved in the
identification of major infringers nationwide and has assisted in the
identification and seizure of hundreds of thousands of dollars in counterfeit
product. The company has an excellent rapport with local law enforcement
and U.S. Customs in approaching the problem with a wide range of solutions,
which include service of cease and desist letters (often resulting in the voluntary
surrender of infringing goods); criminal actions, both federal and state; and
civil suits and seizure. In addition, the company maintains a large database of
known and/or convicted infringers, printers, importers, and other violators. The
firm also conducts investigations into prior use of trademarks, grey market
importation, patent infringements, the status of registered marks, and other
matters pertaining to intellectual property rights.
